Terms of sale for retail goods

This document is an offer by ИП ОСПАН, IIN 931227300873 (the “Seller”) to enter into a distance retail sale contract on the terms set out below.

1. Terms

The website is https://ermart.kz/. The Buyer is a natural person purchasing goods for personal, family, household or other needs unrelated to business activity. An Order is the selected goods and delivery details.

2. Subject

The Seller transfers the goods into the Buyer’s ownership, and the Buyer accepts and pays for them. Description, price and availability are shown on the product card and confirmed when the order is processed.

3. Conclusion of the contract

Listing a product on the site is treated as a public offer of that product where the law so provides. The Buyer’s order is an acceptance of the applicable terms, but for cash on delivery the Seller additionally confirms stock, price and the method of fulfillment. An automatic message that the request was received is not always confirmation that the goods are in stock.

4. Placing an order

• The Buyer selects the goods and provides accurate contact details.
• The Seller contacts the Buyer if anything needs to be clarified.
• The final amount, delivery and payment are agreed before fulfillment.
• The Buyer must check the order details before confirming.

5. Price and payment

All prices are shown in tenge. Delivery may be charged separately. Payment methods are set out in “Delivery and payment”.

6. Delivery and passing of risk

The terms are set out in “Delivery and payment”. Title and the risk of accidental loss pass as provided by law and by the chosen method of handing over the goods.

7. Quality, warranty, returns

The goods must match the description and mandatory requirements. Exchange, returns and defect claims follow the Law of the Republic of Kazakhstan “On Protection of Consumer Rights” and the document “Exchange and returns”. These terms of sale do not reduce the consumer’s mandatory rights.

8. Liability

The parties are liable under the laws of the Republic of Kazakhstan. The Seller is not released from liability that cannot be excluded by agreement. A party is not liable for non-performance caused by force majeure where the conditions provided by law are met.

9. Claims and disputes

The Buyer sends an enquiry by phone/WhatsApp +7 (708) 935-54-94. Please include the order number, your request and supporting materials. Disputes are resolved by negotiation and, if no agreement is reached, as provided by the laws of the Republic of Kazakhstan.

10. Changes to the terms of sale

A new edition applies to orders placed after it is published, unless the law provides otherwise. A contract already concluded is governed by the edition in force when it was made.
